1 Acceptance of Terms

Welcome to Even Matchup Gaming ("EMG," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, events, tournaments, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of any modifications.

2 Eligibility

To use our Services, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable law
• Provide accurate and complete registration information

If you are under 18, you represent that you have your parent or guardian's permission to use the Services and that they have read and agree to these Terms on your behalf.

3 Event Participation

When participating in EMG tournaments and events, you agree to:

• Abide by all tournament rules and guidelines
• Conduct yourself in a professional and respectful manner
• Not engage in cheating, collusion, or match-fixing
• Not use unauthorized software, hardware, or modifications
• Comply with all venue rules and regulations
• Accept the decisions of tournament officials as final

We reserve the right to disqualify any participant who violates these terms or engages in unsportsmanlike conduct, without refund of any entry fees.

4 Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, videos, and software, is the property of Even Matchup Gaming or its licensors and is protected by intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content without our prior written permission. The EMG name, logo, and all related marks are trademarks of Even Matchup Gaming.

5 Media Rights and Consent

By participating in our events, you grant EMG the irrevocable right to:

• Photograph, film, and record your participation
• Use your name, likeness, and gaming handle in promotional materials
• Broadcast, stream, and distribute recordings of your gameplay
• Use recordings for archival, promotional, and commercial purposes

This consent is granted without compensation unless otherwise agreed in writing.

6 Code of Conduct

All participants, attendees, and users must adhere to our Code of Conduct. The following behaviors are strictly prohibited:

• Harassment, discrimination, or hate speech of any kind
• Physical violence or threats of violence
• Sexual harassment or inappropriate conduct
• Theft, vandalism, or destruction of property
• Use of illegal substances on event premises
• Disruptive behavior that interferes with events
• Impersonation of staff or officials

Violations may result in immediate removal from events, permanent bans, and reporting to law enforcement where appropriate.

7 Refunds and Cancellations

Refund policies for event registrations and merchandise purchases:

• Event Registrations: Refund requests must be submitted at least 14 days before the event date. Refunds are subject to a processing fee.
• Merchandise: Returns accepted within 30 days of purchase for unworn/unused items with original tags.
• Cancelled Events: If EMG cancels an event, registrants will receive a full refund or the option to transfer to a future event.

8 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, EMG DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10 Indemnification

You agree to indemnify, defend, and hold harmless Even Matchup Gaming, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Services, violation of these Terms, or infringement of any third-party rights.

11 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Toronto, Ontario.
